Called to Order at 7:30 PM under M.G.L. Chapter 131, s.40 and the Hanson By-Law 3-13, s.5. by Philip R. Lindquist, Chairman, in Meeting Room A on the top floor of the Town Hall

Discussions

56 Indian Path (DEP #SE175-425) – Request for Certificate of Compliance
32 Country Lane (DEP #SE175-419)– Request for Certificate of Compliance
The Commission reviewed the above Requests and determined that a letter from an Engineer certifying compliance should be submitted in lieu of an as-built.   A request for a waiver from this condition was discussed, but the Commission determined that since it was a requirement of the State Wetlands Protection Act, it could not be waived.
974 E. Washington Street (DEP #SE175-408) – Expired OOC
Ms. Nehiley explained that the Orders of Conditions for this project had not been recorded at the Registry of Deeds as was required.   However, the work had been done and certified by the Board of Health.  The Commission instructed Ms. Nehiley to write a letter to the owners requesting that the OOC’s be recorded even though it was after-the-fact.
Whitman Hanson Regional High School (DEP #SE175-388)- Request for Certificate of
Compliance
Mr. Lindquist stated that he would like to reconsider the vote against issuance of the Certificate of Compliance taken at the meeting of 3/13/07.  His argument was that retention basin D, which has been described in different ways in the past is a detention basin and is functioning basically as designed.  He also contended that the remaining work will be done by the High School’s own staff as discussed at the last meeting with them.  He proposed to issue a Partial Certificate of Compliance with conditions specifying ongoing maintenance of the drainage system and the continued viability of the wetland replication area.  Mr. Schellenger disagreed with Mr. Lindquist over the functionality of the basin.  He questioned the elevations on the as-built.

The Commission decided to schedule a site walk at the High School to make observations and discuss further.  

Police Station (DEP #SE175-0492)
A response to the Commission’s letter dated 1/10/07 requesting a description of the alternative stormwater treatment design was not received.  Ms. Nehiley was asked to draft another letter addressed to the design engineer and make a second request for said information.  
Dunham Farms  (DEP #SE175-0504)
John Kemmett had recently accompanied a representative, Andrew Spaefski, from the Environmental Protection Agency (EPA) to inspect the drainage at Dunham Farms.    Mr. Spaefski will prepare an opinion and submit it to the Commission.  
Bay State Gas – repair of existing gas lines on King Street
Phil Lindquist had met with a representative from Bay State Gas to discuss erosion control along King and East Washington Streets that would protect sensitive areas during maintenance of gas


lines.  Mr. Lindquist had requested a more detailed plan with a description of the bio-tech silt fence that will be utilized and a dewatering detail.

Agent Update
Michael Finglas, Town Administrator and Phil Lindquist had conducted interviews.  After picking a candidate, they were now in the process of checking references.  Mr. Finglas will
negotiate salary and benefits.
